Aren't civil and common different types of law? There's zero incentive for the state to write a statute where members of their enforcement arm would have liability for lack of action. Civil law is statutory, is it not?

I would think that Common Law would say that police do have a duty to protect, as is the understanding of most common people, as evidenced by responses in this thread.
